SHORES, Justice.
This is the second time this case has reached this court. In Cates v. Bush, 293 Ala. 535, 307 So.2d 6 (1975), the appeal was dismissed since there was no final judgment to give this court jurisdiction.
In the original complaint, as amended, the plaintiff sought to sell certain lands for division with the proceeds to be divided among claimants thereto, and the commuted value of the plaintiff’s life estate to be determined and paid to the plaintiff, Fred Bush.
