By this action, as originally commenced in the superior court for King county, the plain*645tiff, Rostein, sought recovery from the United States director general of railroads, in charge of the lines of the Chicago, Milwaukee & St. Paul Railway Company, of five car-loads of used railroad rails, which rails had been sold as scrap rails by the duly authorized representative of the director general to Victor Lamken, who in turn, as it is claimed, had sold the rails to his brother, Arthur Lamken, who in turn had sold the rails to the plaintiff; the rails not having been delivered by the director…
