In 1863, J. C. Burbank, John L. Merriam and the plaintiff, as partners under the name of J. C. Burbank & Co., were engaged in transporting passengers, by stage, between LaCrosse and St. Paul. The defendant and others owned and operated a ferry-boat across the Mississippi river at Hastings, in this state. In attempting to cross on the ferry-boat, on March 27, 1863, the stage-coach fell into the river, and Matthew McLean, a passenger therein, was drowned.
