In a proceeding for the probate of a will, the special guardian of two children of the decedent bom after the execution of the document and surviving the testator, prays for a construction of the will and for a determination as to whether or not his wards are entitled to a distributive share of the decedent’s estate pursuant to section 26 of the Decedent Estate Law (Laws of 1909, chap. 18; Consol. Laws, chap. XIII). The will was permitted to go to probate and the question of construction was reserved and is now to be determined.
