STANLEY, Commissioner.

This is an action by Freda Riéhie-by her next friend to recover damages for - personal injuries sustained as a guest in an automobile-of Robert L. Chears when the car ran off- the street and struck a utility pole. The driver had dropped off asleep. The" court directed a verdict for the defendant on the ground’ of contributory negligence."

The defendant, now appellee, was a soldier stationed at Fort Knox. He lived or stayed at the home of Freda’s parents in Louisville when on a pass or leave.-. On the. occasion of the accident he and Freda,who is his second cousin, (with…
