Appeal from a judgment of the Supreme Court (Lynch, J), entered February 16, 2011 in Albany County, which granted petitioner’s application, in a proceeding pursuant to CPLR article 78, to annul a determination of respondent Empire Zone Designation Board revoking petitioner’s certification as an empire zone business enterprise.
