Ascione, J.), entered June 6, 1986, which granted defendant-appellant-cross-respondent Sterling’s motion pursuant to CPLR 3212 for summary judgment to the extent of dismissing the second and third causes of action and which denied Sterling’s motion to dismiss the first cause of action, unanimously modified, on the law, to dismiss the first cause of action and otherwise affirmed, without costs.
