This is an original submission upon an agreed statement of facts filed pursuant to the provisions of R. L. H. 1935, §§ 3616 to 3619, both inclusive.
The trustees under the will and of the estate of Bernice P. Bishop, deceased, hereinafter called “the trustees,” appear both for themselves and for the tenants of the ahupuaa of Makalawena who had been such prior to the *615year 1900. J. H.
