National City Bank (“NCB”) has filed a complaint to determine the dischargeability of a $7,061.43 credit card obligation (the “Card Obligation”) incurred by the debtor Thomas Edward Manning (“Manning” or “Debtor”) approximately one month before he filed his voluntary Chapter 7 petition on November 8, 2000 (the “Petition Date”). NCB seeks a determination that the Card Obligation is nondischargeable under 11 U.S.C. § 523(a)(2)(A), asserting that Manning obtained the debt by false representation.
