SIMPSON, Circuit Judge:

The appellant, Daniel Smith, and his co-defendant Charles Mains, Jr. 1 were indicted for forcibly breaking into the Brookview Branch contract postal station in suburban Jacksonville, Florida, with intent to commit larceny in violation of Title 18, U.S.C. Section 2115. 2 Following trial and a jury verdict of guilty, the court sentenced Smith to five years imprisonment.

A résumé of the evidence upon which the jury found Smith guilty is necessary to an understanding of the appellant’s claims of error.
