This is an original proceeding instituted in this court, asking for a writ of mandate against tbe district court of Box Elder county, directing that court to set aside and hold for naught findings of fact, conclusions of law and judgment, as well as to strike from the files of said court the summons and return and certificate of service thereof in two actions in which the plaintiff here, Bankers’ Commercial Security Company, was plaintiff, and Nephi Bott and LeRoy Bott, respectively, were defendants.
