I. The pi’operty in controversy is certain real estate in the city of Davenport, upon which there is situated a saw mill, planing mill, etc. It is known as the “ Davis Saw Mill Property,” and was formerly the property of John L. Davis, deceased, who owned the same at the time of his death. On" the second day of February, 1880, F. H. Griggs, the administrator of Davis, conveyed the real estate in controversy to said Simon B.
