This consolidated appeal arises under SCRA 1986, 12-102(A)(1) (Repl.Pamp.1992) (breach of contract action appeals heard by Supreme Court). The consolidated eases are Albuquerque Testing Laboratories v. Page & Wirtz Construction Co. (No. 20,223) (“Albuquerque Testing”) and State ex rel. Bob Davis Masonry, Inc. v.
