Appeal from a judgment of the Supreme Court at Special Term, entered October 24, 1979 in Albany County, which denied petitioners’ application, in a proceeding pursuant to section 16-102 of the Election Law, seeking to declare valid the certificate of nomination nominating petitioner Balio as a candidate of the Right to Life Party for the office of Justice of the Supreme Court in the Fifth Judicial District in the November 6, 1979 general election.
