1Opinion of the CourtStaples, J.

After appealing from conviction by a trial justice, the defendant was tried before a jury in the Circuit Court of Dickenson County on a warrant charging the sale of whiskey in violation of section 40 of the Alcoholic Beverage Control Act (Michie’s Code, section 467 5 (40)). The warrant also charged that he had “previously been convicted of violating the Virginia Alcoholic Beverage Control Act.” The jury returned a verdict of guilty and imposed a fine of $100 and confinement in the county jail for 30 days. This writ of error was granted to review the judgment entered on said verdict.
