DILLON, Circuit Judge.

The plaintiff is the receiver of the National Bank of the State of Missouri, appointed by the comptroller of the currency June 23d, 1S77, the bank having suspended payment three days before. Rev. St. § 5234. The defendant Lafiin had for some years prior to May 16th, 1S77, been the holder of eighty-five full-paid shares in that bank. At the date of the suspension of the bank the defendant, James H. Britton, was its president, and had been such for years prior to that event.
