This is an action on the case by Christian Schmalfeld, as administrator of the estate of Mary Schmalfeld, deceased, against the Peoria & Eastern Railway Company, to recover damages for the death of plaintiff’s intestate, alleged to have been caused by the negligence of the Cleveland, Cincinnati, Chicago & St. Louis Railway, the alleged lessee of the defendant. . Hpon a trial by jury in the circuit court of McLean county there was a verdict and judgment against the defendant for $1,000, from which judgment the defendant prosecutes…
