Defendant Allen Thomas was convicted after a nonjury trial, of breaking and entering, MCLA § 750.110 (Stat Ann 1962 Rev § 28.305). On appeal as of right this Court remanded 1 for the purpose of establishing a testimonial record detailing the reasons for the delay in bringing defendant to trial and a redetermination by the trial court of its previous denial of defendant’s motion to dismiss. The hearing was held, and the trial court reaffirmed its denial of defendant’s motion.

At the beginning of 1967, defendant was on parole from Jackson prison where he was serving a sentence for armed robbery.…
