This is an action brought by tbe obligee named in a bond given in probate by tbe executrix of the will and estate of Margaret Y. Garter, deceased, against the principal and sureties thereon, for breach of condition. The plaintiff bad judgment in tbe circuit court, and tbe case is here on tbe bill of excep*404tions of the principal and one of the defendant sureties.
