Affirming-

The appellant, John (Pete) Montjoy, was indicted by the grand jury of Kenton county, in which he was charged with the crime of raping Mrs. Irene Cummings, whose husband was an employee of a railroad company in the operation of its trains. At his trial he was convicted, with the infliction of a death sentence as his punishment. He appealed to this court, and the judgment was affirmed in an opinion rendered in the case of Montjoy v.
