This is an appeal on questions of law and fact by the Board of Education of Hamilton county, Ohio, from a judgment rendered against it in an action by the Board of Education of Berea Rural School District of Hamilton county, Ohio, perpetually enjoining it from putting into effect a resolution passed by it, on the 10th day of August 1937, providing for the consolidation of the Berea, Elizabethtown and Whitewater township rural school districts.
