This opinion is rendered in support of the order of this court dated February 17, 1981.

We address defendant’s motion to dismiss certain counts of a 106 count information filed on June 18, 1980. Six of the counts were dismissed at the time of the preliminary hearing. The information on each of the remaining 100 counts alleges the offenses were committed while defendant was a public officer or employee, and in a fiduciary position in the course of his employment as Executive Director of Jersey Shore Hospital.
