The defendant, Hanley Boyston Booth, was charged in the district court of Custer county with the crime of obtaining money by false pretenses, was tried, convicted, and sentenced to- serve one year in the State Penitentiary, and has appealed to this court.

The assignments of error Avill be discussed in the order in which they were presented in the defendant’s brief.

It is first urged that the information is insufficient to charge the offense of obtaining money under false pretenses or to give the court jurisdiction to' try said cause.
