WISDOM, Circuit Judge.

This is an appeal from a judgment of the District Court for the Southern District of Florida dismissing Julius Hy-man’s suit against Joseph Regenstein. Suit was filed in the Circuit Court of Palm Beach County, Florida, and removed on the ground of diversity of citizenship. The matter in controversy is said to involve some $20,000,000.

The complaint alleges that Regenstein was in a fiduciary relationship with Hy-man that he violated by acts of fraud, deceit, and overreaching. The prayer asks for imposition of a constructive trust, an accounting, and damages.
