¡¿Teresa Hightower instituted proceedings for divorce against her husband, Shaun Schwartz, under La. Civil Code art. 102. During the rule-to-show-cause hearing, Mr. Schwartz’s counsel sought to cross-examine Ms. Hightower regarding the reconciliation of the parties. Ms. Hightower’s counsel objected to this questioning, asserting that Mr. Schwartz, had failed to notify counsel by pleading of his intention to raise, what Mr. Schwartz characterized as, the “affirmative defense” of reconciliation.
