ON THE MERITS.

CALHOUN, Judge.

On a former day of this term, this appeal was dismissed for the failure to file a transcript in the mode and manner provided by statutes. Permission was granted to .the district clerk of Travis county to withdraw same and prepare and file a new and complete transcript in compliance with the statutes. This having been done, this appeal will now be considered upon its merits.
