Plaintiff in error contends earnestly, and not without reason, that the evidence does not support the verdict by that degree of proof required in a criminal case. The evidence as to some of the material matters was conflicting, and it was the peculiar province of the jury to weigh it and to determine the credibility of the witnesses. As the credibility of two of the witnesses was improperly attacked by the State and substantial error was committed in other respects during the progress of the trial, we will not pass upon the question whether the evidence was sufficient to support the verdict.…
