Ajudgment in this cause was reversed by this court because in its opinion the trial court had committed error in directing a verdict for the defendant. (82 S. W. Rep., 808.) At the recent trial the case was submitted to the jury, and in addition to alleged errors in the charges and the amount of the recovery, appellant brings into question the sufficiency of the evidence adduced at this trial to support the verdict, and insists that the undisputed evidence showed that the danger involved in carrying the rail was an assumed risk as a matter of law; and that plaintiff…
