DIXON, Chief Justice.

This is a divorce case, but the appeal is concerned only with that part of the trial coqrt’s judgment having to do with a division of property between the parties.

*257Appellee as plaintiff brought the suit. Appellant answered and filed a cross-action. After return of a jury verdict the court granted appellant a divorce on her cross-action, set aside certain property to appellee as his separate property, and divided a small amount of community property between the parties. No issues were submitted to the jury and none were requested by either party pertaining to the question…
