OPINION

MITCHELL, Judge.

jimmy Pique, who will be referred to as the defendant or by name on November 23, 1970, was convicted in the Circuit Court of Jefferson County, Tennessee of burglary in the third degree of the business house of Baker Motors of Dandridge, Inc. on or about the 28th day of April, 1970. The jury fixed the punishment at three years in the State Penitentiary. After the motion for a new trial had been heard and overruled the trial judge Honorable George R. Shepherd pronounced judgment that the defendant Jimmy Pique for the offense of burglary be confined in the State…
