This suit was tried in the district court of Jefferson county, the venue having been changed by agreement from Hardin county, and the matters in controversy were submitted to the court for decision, without the intervention of a jury.
The material allegations of plaintiff’s petition are as follows:
Appellant sued appellee, individually and as survivor in community of T. W.
