The defendant was brought to trial in the Superior Court on two indictments, one charging him with the crime of rape and the other with assault and battery. At the conclusion of the first day of the trial, at which both the victim and the examining physician testified, the defendant’s counsel consulted with the assistant district attorney to determine what recommendation he would make to the court as to sentence should the defendant change his pleas to guilty.
