This matter came before the Court on September 23, 2009. Subsequent to a bench trial and after considering the pleadings and the arguments of counsel, the Court took the matter under advisement. The following embodies the Court’s ruling.

Facts

This is a dispute between providers of municipal water service in the northeastern part of Fairfax County. No evidence was presented as to the history of how the City of Falls Church (the “City”) and the Fairfax County Water Authority (“Fairfax Water”) became two separate water authorities and which was the initial provider.
