Plaintiff Steven A. Long, a former employee of defendant CSX Transportation, Inc., brings this action through counsel under the Federal Employer’s Liability Act (FELA), 45 U.S.C. § 51 et seq., for injuries he suffered at work on September 26,1989. This matter is before the Court upon defendant’s motion for summary judgment (doc. no. 11), plaintiffs responses (doc. nos. 12, 17), defendant’s reply (doc. no. 13), and defendant’s motion to amend answer (doc. no. 20).
