In June, 1919, Edwin R. Post and J. M. McDonald and Mary A. McDonald, his wife, entered into an agreement by which Post agreed to sell and the McDonalds to buy certain real estate. About three years later the purchasers, claiming that Post had not complied with his contract, brought this action, the purpose of which was to have the court declare the agreement rescinded, to recover the pur chase price of the land together with the value of the improvements placed thereon by them, and to have a lien on the premises for these sums declared and foreclosed.
