The complaint alleges that “ at all the times hereinafter mentioned, the defendant, Hubert E. Larkin, and. one Alexander Sangster, were co-partners, engaged in the contracting business at Lock-port, N. Y., under the name of Larkin & Sangster, until the death of said Alexander Sangster, prior to the commencement of this action, and that the defendant, Hubert E. Larkin, is now the surviving partner of said firm; (2) That on or about April 15th, 1911, the plaintiff and said Hubert E.
