Fishbeck v. State

Appellant was charged by indictment with the unlawful killing of Jacob John Fishbeck, her husband; and upon her conviction, she was awarded a penalty of ten years in the penitentiary, and she appeals.

It was shown by the state's testimony that the deceased and some of his friends spent a portion of the night previous to his death in a coon hunt in the field of a neighbor; that a case of beer was consumed by such hunters; but they caught no coons; that deceased agreed at such time that on the following Wednesday, he would procure some good dogs and they would again take this hunt; that these…
