The defendant herein pleaded guilty to a charge of possession of lysergic acid diethylamide in violation of Neb. Rev. Stat. § 28-416(1)(a) (Reissue 1979). Lysergic acid diethylamide is a nonnarcotic Schedule I drug. Neb. Rev. Stat. § 28-405 (Reissue 1979). As such, it is a Class IV felony. Neb. Rev. Stat. § 28-416(2)(b) (Reissue 1979). Punishment for a Class IV felony is a maximum sentence of 5 years imprisonment or $10,000 fine, or both, with no minimum. Neb. Rev. Stat. § 28-105 (Reissue 1979).
