On the 10th day of October, 1916, we handed down an oral opinion in this case. Appellant has filed his motion for a written opinion, and in compliance with such request we present the following:

For the purpose of clearly presenting the contentions of the parties, we make the following statement:

On the 29th day of September, 1838, Surveyor H. Trott surveyed and located a tract of land known as the Owen’s survey in Harris county.
