ERROR to the Gibson Circuit Court.

— This was an indictment, found at the Vender-burgh Circuit Court, against the plaintiff in error, and, by a change of venue, tried in the Gibson Circuit-Court. The caption shows that the indictment was found by a grand jury impanelled and sworn at the Circuit Court of the former county, (naming the judges,) at its September term held at, &c., on, &c. The indictment contains three counts. The first count alleges that the plaintiff in error, on, &c., at, &c., “with force and arms, in and upon one A. M. S., the wife of one M. S., of, &c., then and there being, violently and feloniously did make…
