TIREY, Justice.

J. E. Dunaway, a resident of Palo Pinto County, sued R. S. LeSage, a resident of Dallas County, Texas, in the District Court of Ellis County, Texas, alleging that Dun-away had conveyed 346.34 acres of land in Ellis County to LeSage for an agreed consideration of $48,488, and that all of the consideration except $3488 had been paid. The plaintiff sued for $3488 and for the establishment and foreclosure of an equitable lien against said tract of land.
