This was an action of ejectment, brought by Rachel Shackleford, widow of Bennet C. Shackleford, to recover land belonging to her in her own right, which had been conveyed in fee, by her late husband, during the coverture.

On the trial, the plaintiff exhibited a patent to herself, before her marriage, for eight hundred acres of land; and proved the death of her husband in 1823; and that the defendant was in possession of a part of the land included within her patent, at the commencement of the…
