The same questions were made in both of these cases, and they were argued together; and this decision and .judgment will apply to both.

The commissioners of roads and revenues of Pulaski county issued an execution against Pollock, the tax-collector of the county, and the sureties on his bond, for the sum of $2,512, with twenty per cent, per annum *271penalty, from the 21st of May, 1888.
