This is an application for a writ of mandate to require the respondent to proceed with the arraignment and trial of relator upon an indictment charging him with grand larceny. The indictment was presented to the superior court and filed with the clerk on October 16, 1934. It appears that, on the next day, October 17, 1934, the relator, with his attorney, appeared before the respondent demanding that he be arraigned and given a speedy trial by jury.
