OPINION

WEISBERG, Judge.

The State of Arizona on behalf of the City of Phoenix (the City) petitions this court to accept special action jurisdiction and reinstate Scott Moore’s municipal court conviction for criminal damage. For the following reasons, we accept jurisdiction and grant relief.

FACTUAL AND PROCEDURAL HISTORY

Moore was convicted of assault and criminal damage in Phoenix Municipal Court. The charges .arose out of an incident in which Moore assaulted his wife and broke down the door of their home. The home was owned in joint tenancy by both Moore and his wife. On appeal to the superior…
