The plaintiffs, Society of Jesus of New England (Jesuits), bring this petition pursuant to 42 U.S.C. § 1988 (1988), for an award of.appellate attorneys’ fees against the defendant, Boston Landmarks Commission (commission). In the underlying case, Society of Jesus of New England v. Boston Landmarks Comm’n, 409 Mass. 38 (1990), the Jesuits successfully defended the Superior Court’s grant of summary judgment in their favor.
