At the general election in 1890 John J. Puttmann was elected auditor of Decatur county, *318and entered upon the discharge of his duties for a term of four years on the 17th of November, 1891. On the 3d of April, 1891, James Kennedy, then the auditor of said county, wrote appellants in response to a letter from them, requesting them to furnish poll books,-tally papers and election blanks for said county for the November election of 1892, which order was then accepted by appellants at the agreed price of $162.47.
