This court at the March term, 1907, held that the trial judge erred in not sustaining the general demurrer to the plaintiff’s petition. A statement of the allegations of the original petition is set forth in the opinion of Chief Judge Hill, reported in 2 Ga. App. 162 (58 S. E. 374). Before the judgment of this court was made the judgment of the trial court, the plaintiff offered an amendment to his petition. He set up, as additional allegations, that at the time of the injury complained of, the defendant company had in force the following rules: “Bule 31. The engine bell must be rung on…
