Appellant was convicted of the murder of Mrs. Susan Mastín, with the infliction of the death penalty. We will* treat the questions argued by counsel for appellant in their order of presentation in brief.
Motion was made to quash the special venire upon the ground that it was not drawn according to law; that only one of the judges of the circuit court was present at the time and place of drawing said special venire, whereas the statute provided that two of the judges shall draw the same.
