OPINION

SWEET, District Judge.

Plaintiff John Ruiz (“Ruiz” or “Plaintiff’) has moved pursuant to Rule 56 of the Federal Rules of Civil Procedure for summary judgment against Defendant Sauerland Event GmbH (“Sauerland” or “Defendant”). Sauerland has cross moved for summary judgment to dismiss the complaint of Ruiz. Based upon the facts and conclusions set forth below, the motion of Ruiz is granted, the cross motion of Sauerland is denied, and judgment will be entered in favor of Ruiz in the amount of $222,225.20 with interest and costs.
